  • WHAT DOES "CLAIMS MADE" MEAN? - Professional liability policies are usually written on a claims-made basis.  This means the policy in effect the date a claim is made is the policy that responds. 
  • HOW DOES THE DEDUCTIBLE APPLY? - The policy deductible usually applies to each claim and may or may not apply to the cost of defense.  
  • WHAT LIMITS DO I NEED? - The policy limit of liability includes defense costs, meaning that the limit is eroded and can be exhausted by legal fees and other defense costs.  Careful consideration should be given when determining what limits to have, including your history, projects, and a review of the legal climate.
